This is a student project. Never Driven was made for the course IDATA2503 Mobile Applications at NTNU, fall 2026. It is not a commercial product, there is no company behind it, and it may be shut down at any time, at the latest when the course ends. These terms are written in the style of real terms, but they exist as part of a school assignment.
1. Introduction and acceptance
1.1 These Terms and Conditions (the "Terms") govern your access to and use of the Never Driven mobile application and the related web pages (together, the "Service").
1.2 The Service is developed and operated by a student at the Norwegian University of Science and Technology (NTNU) as coursework (the "Developer", "we", "us"). NTNU is not a party to these Terms and does not operate the Service.
1.3 By creating an account, signing in, or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by the Privacy Policy. If you do not agree, you must not use the Service.
2. Definitions
In these Terms:
- "Account" means the user account created when you sign in with your email address.
- "Drive" means a trip recorded by the Service, from when recording starts until it stops.
- "Experience" means the totals the Service derives from your Drives, such as time and count per road type, light, surface, weather, traffic and road feature.
- "Suggestions" means notices from the Service about driving conditions you have little or no Experience with.
- "User Content" means information you enter into the Service yourself, such as manually logged manoeuvres.
3. Eligibility
3.1 The Service is intended for learner drivers and their supervisors. You may use the Service regardless of whether you hold a driving licence.
3.2 If you are under 18, you should only use the Service with the knowledge of a parent or guardian. If you are under 13, a parent or guardian must agree to your use of the Service on your behalf.
3.3 You must provide a valid email address that you control. You are responsible for keeping access to that email address and your device secure.
4. Description of the Service
4.1 The Service records the location of your device while you drive, works out which conditions you drove in, and keeps a log of your Experience. It may show Suggestions for conditions you have not yet practised.
4.2 To work out the conditions of a Drive, the Service relies on external data sources for road, weather, light and place information, as described in the Privacy Policy.
4.3 The Service is provided free of charge. We may change, suspend or discontinue any part of the Service at any time, without notice and without liability to you.
5. Safety
5.1 The Service is a practice log only. It is not a driving instructor, does not replace lessons or mandatory training, and does not assess whether you are ready to drive or to take a driving test.
5.2 Road, weather, surface and light information shown by the Service is derived automatically and may be inaccurate, incomplete or out of date. A Suggestion is not a statement that it is safe or appropriate to drive in those conditions.
5.3 You, and any supervising driver, are solely responsible for deciding whether, when and where to drive, and for complying with all applicable traffic laws and regulations.
5.4 You must not handle your device in a way that breaks traffic law or distracts the driver while the vehicle is moving.
6. Your obligations
6.1 You agree not to:
- access or attempt to access data belonging to other users;
- interfere with, overload or disrupt the Service or the third-party services it relies on;
- reverse engineer the Service in order to circumvent its security rules;
- use the Service for any unlawful purpose or in breach of these Terms.
6.2 You are responsible for the accuracy of User Content you enter.
7. Licence and intellectual property
7.1 Subject to these Terms, you are granted a personal, non-exclusive, non-transferable and revocable licence to install and use the Service for your own, non-commercial purposes.
7.2 The Service, including its design and code, remains the property of the Developer, except for third-party components and data, which remain the property of their respective owners and are used under their own licences.
7.3 You keep any rights you have in your User Content. You permit us to store and process it only as needed to provide the Service.
8. Third-party services
8.1 The Service depends on services operated by third parties, including Google Firebase, Open-Meteo, sunrise-sunset.org and your device's location and geocoding services. Their availability and accuracy are outside our control.
8.2 Your use of those services through the Service may also be subject to their own terms and privacy policies.
9. Disclaimer of warranties
9.1 The Service is provided "as is" and "as available", as an unfinished student project. To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of accuracy, reliability, availability, fitness for a particular purpose or non-infringement.
9.2 We do not warrant that the Service will be uninterrupted or error-free, that recorded Drives or Experience will be correct, or that data will be preserved.
10. Limitation of liability
10.1 To the fullest extent permitted by law, the Developer is not liable for any direct, indirect, incidental or consequential loss or damage arising from your use of, or inability to use, the Service, including loss of data and any loss or damage connected with driving.
10.2 Nothing in these Terms limits liability that cannot be limited under applicable law, or your statutory rights as a consumer.
11. Termination
11.1 You may stop using the Service at any time and ask for your Account to be deleted as described in the Privacy Policy.
11.2 We may suspend or delete your Account if you breach these Terms, or as part of shutting down the Service.
11.3 When the Service is shut down, your Account and all associated data will be deleted. Sections 5, 9, 10 and 13 survive termination.
12. Changes to these Terms
12.1 We may update these Terms from time to time. The version number and effective date at the top of this page show the current version.
12.2 Continued use of the Service after a change takes effect means you accept the updated Terms.
13. Governing law
13.1 These Terms are governed by Norwegian law.
13.2 Any dispute should first be raised with us through customer service, so we can try to resolve it informally.
14. Contact
